If the DoMA was not in effect, would a domestic partnership receive the same benefits from the military?

I was wondering. hypothetically if the DoMA ( Defense of marriage act ) Was not in effect, would a couple joined by a Domestic partnership; receive the same benefits if one partner is in the military.Same as a married couple.

Answer: DoMA wouldn't change anything in regards to domestic partners, which is different than marriage. If DoMA didn't exist, then same sex partners could get married. Married people receive benefits, so same sex MARRIED couples would receive benefits. Domestic partners would not under the current (non-DoMA) laws.

Is Sotomayor the key vote in DOMA, when she asked whether states have the right not to recognize gay marriage?

She asked if DOMA is struck down, then could individual states like Ohio (which banned gay marriages) refuse to recognize gay marriages from other states that permit it. IOW, if DOMA is struck down, then one single state can dictate to all other states and to the federal government that all of them must recognize gay marriages.

Answer: She's not the key vote, Kennedy is. She is already for gay marriage.

And that's not what it's about. Currently, if someone is married in one state, it is recognized in all other states. So if cousins get married in one state, it is recognized in all other states, even if it is illegal in some states. So she was taking the opposite view, being a devil's advocate, that if it's banned in one state, do they have a right to ban it for all other states, which is kind of what DOMA is doing on a federal level.

Why does Obama claim Marriage is a state issue when he refuses to defend DOMA?

DOMA is the defense of marriage act. It was passed because states are required to accept Marriages from other states. Leftists would like to force states to accept gay Marriages from gay states, hence DOMA. So if Obama really thinks Marriage is a state issue wouldnt he be defending DOMA?

Answer: The legalisation of same sex marraiges is required at a State level. The DOMA allows States that don't recognise same sex marriages to not accept marriages from other States (that do allow them).

So the legalisation of same sex marriages is a State issue. Changes to the DOMA would be required for them to be Federally recognised across all States (including all partner insurance benefits for same sex marriages).

I would imagine that there wouldn't be much point in changing the DOMA unless the majority of States legalised same sex marriages first (otherwise you won't get enough support at a federal level).

The Defense of Marriage Act or DOMA (January 10. 2009), as it is more commonly called, is a federal law that a) says that states dont have to recognize same-sex unions from other states, and b) the federal government will not recognize those marriages, even if the state does. With DOMA in place, we cannot have marriage equality!

(referring to the lawsuit that GLAAD filed to challenge section 3 of DOMA)

the DOMA lawsuit was dismissed on a technicality of being improperly filed...........

and the plaintiffs were "likely to refile"........

which leaves me with two questions:

1. Has it been refiled yet?

2. If its refiled and this lawsuit plays out.........what are the chances that it will go to the SCOTUS?

Answer: 1. It has been refiled and they expect to begin the first hearings next year.

2. Very likely.

Im confused as to why people in the military that are straight are able to have their spouse on base but not gay couples. I assume its because DOMA prevents the military from recognizing same-sex marriage. If it were to be repealed, would that grant gay people in the military to the same rights as straight servicemen when it comes to spouses and marriage benefits?

Answer: it would be a step there, however civil issues in the military fall under both federal and state law. So until there is a national law stating that same sex couples can marry I don't see that happening.

If a same-sex couple who lives in a state that does not recognize same-sex marriage (lets say Texas) were to get married in a state that allows it, such as Massachusetts, could they then return to Texas and still be recognized as married?

Answer: Even if they repeal DOMA you still have to recognize same-sex marriage at the federal level to give those couples federal benefits. The DOMA prevents that. So it would still be recognized only in same-sex states. The states can still not recognize the marriage because it is a state's right to do so. You should see what is in DOMA then you can figure it out.

Can only 1 House of Congress defend DOMA in the Courts?

Pending the DOJs determination to not defend DOMA, and that the Houses of Congress are divided politically, Can the House alone defend DOMA (without approval from the Senate) in the current pending cases or in future cases, or must Both Houses approve such a move?

Answer: DOMA is the law, no one in Congress needs to "defend it". Until the law is repealed by Congress and the law signed by the President or the Supreme Court rules it unconstitutional or lets a lower court ruling stand that it is unconstitutional, it is the law of the land.
