Answer: No. I don't think so. The Health Care Reform Act is one of the bravest acts of any president in my lifetime. Only fools would not agree.

Why is John Duns Scotus forgotten and Thomas Aquinas still discussed?
John Duns Scotus are almost never quoted or discussed nowdays, while someone like Thomas Aquinas are used for all kinds of discussions and quotes. Why have J Duns Scotus fallen in bad soil when T Aquinas still have such a great following?
Answer: There are 2 different philosophers- Johanaus Scotus Erigena, a mystical neo-Platonist- who was condemned for being too mystical and Duns Scotus who was and is still regarded as important. Duns Scotus was more 'nominalist' (Aristotelian) and his philosophy emphaisized haecceity (the unique 'thisness' of things). Aquinas is the mainstream Aristotelian who reconciled philosophy with the teachings of the Catholic Church by taking a middle path.
Heidegger's thought could be said to take up from where Duns Scotus left off. The poetry of Gerald Manley Hopkins too focuses on haecceity. Thus, outside the older sort of Catholic philosophy, I don't think it would be true to say that his seed has fallen on stony ground.

How do you think SCOTUS will rule on ObamaCare and Arizonas Immigration Law?
I think its going to be a split.
SCOTUS will rule ObamaCare unconstitutional, at the minimum just the individual mandate, but I suspect the entire law.
But SCOTUS will uphold the Federal govt preeminence of controlling immigration and rule against Arizona.
Answer: Entire HC law will be repealed as Anthony Kennedy usually leans right on economic issues, left on social issues.
Don't know enough about previous SC rulings on immigration, but I sure hope they stand with Arizona.

Are COnservatives suggesting the SCOTUS should be fooled by smoke and mirrors installed by politicians?
Congress clearly passed a 1% income tax, and gave a 1% tax deduction for buying health insurance. However, politicians wrote smoke and mirrors which hid this tax. Conservatives want the SCOTUS to ignore the basic constitutionality of this law, and instead focus on the smoke and mirrors. Is this a healthy view? Should we focus on what a law does, or on what politicians say it does? Are Conservatives suggesting we can trust politicians enough to take their word on what a law does?
Answer: More taxes, loved by government dependent libs!!! Yea we saw that coming!!!

What are possible objections to Duns Scotus argument for the existence of God as a first cause?
I am writing a paper that discusses Duns Scotus argument for the existence of God and need to include and respond to plausible objections to his theory.
Answer: argument for the existence of God as a first cause
~~~ ... fails because of the erroneous assumption of causality. 'Causality' is imaginary.
Quantum, science and philosophy both reject such assumptions.
'Cause' and 'effect' is a clumsy way of saying two mutually arising features (opposite Perspectives) of the same event (One Reality)!
Both 'time' and, thus, 'linearity', that are necessary variables in the theory of causality, only exist in/as 'thought', the imagination.
Reality is a bunch of 'moments' happening/perceived Here! Now!
and on and on...
Suffice to say that the 'creation/causality' theory fails, philosophically and scientifically, but remains a hit on the 'belief/religion' circuit!
If that's all he has, his whole argument fails, it's not a "possible objection", it's an out and out refutation.

So if the SCOTUS rules the Health Care law unconstitutional can the President still implement it with a decree?
I wonder what the President could do, if the SCOTUS rules his health care bill as unconstitutional. Can he issue decrees or executive orders?
Answer: To clarify......the Federal Judge in Florida already ruled it unconstitutional......and now unenforceable.
If a court of appeals isn't filed with by the dems.....then SCOTUS ( if it gets that far ) has 3 ruling options.......
1. Rule not to hear it....then the Federal Judge's ruling in Florida stands.
2. Hears the case and does not overturn the Federal Judge
3. Hears the case and overturns the Federal Judge.

Its been illegal in Chicago for decades to own a handgun. However, Chicago has one of the highest handgun related crime rates in the US. Therefore, how will dems mourn the fact that the SCOTUS will probably overturn the Chicago law banning LAW ABIDING CITIZENS from protecting themselves?

Answer: the whole law would have to be scrapped. since it is argued that it doesn't work without the individual mandate

Lets say that this week the SCOTUS has a press conference with the media. Lets say they used the same tone and said the same things about the POTUS that the POTUS said about them.
Would it be illegal for the SCOTUS to do that while the POTUS was considering signing a bill?
Answer: LOL, can you imagine the outrage if, before passing a law, let's say granting gays the right to marry, if Scalia held a press conference saying "The President would do well to consider the possibility that this is not Constitutional before he plays politics by signing this bill that will likely be struck down." OH HOW THE MEDIA AND THE DEMOCRATS WOULD SCREAM!!

Why waste billions on Implementing the Affordable Health Care Act if it is ruled Unconstitutional by SCOTUS?
If the SCOTUS rules the Affordable Health Care Act unconstitutional, why spend the billions in trying to enforce and implement it in the first place?
Answer: Because it hasn't been ruled as unconstitutional. I think what will happen is the House of Reps (if it stays majority Republicans), will "attempt" to pass a law to void the Affordable Care Act. Then it goes to the Senate, which might remain Democratic and therefore, may not pass it. But even if both the House and the Senate vote to void the law, Obama's mighty veto pen is ready. No President will veto a bill (law) he signed. At this point, Congress may try to override the veto.

What would happen if the Federal Appeals Courts are split on Obamacare and the SCOTUS is also split?
If SCOTUS is split because either Justice Kagan or Justice Thomas recuses themselves from Obamacare and the ruling goes 4-4 and the Federal Appellate courts are also split with half of the circuits ruling against it and the other half ruling for it. What happens to the Law? Does it go into effect or what?
Answer: It will never happen like that. Primarily because no SCITUS judge will recuse. Kagan has good reason to recuse, but most likely will not. She would be in the minority anyway so her recusal would not cause a tie. Thomas has no real reason to recuse although some have tried to make the agurment that he should. It is a safe bet that he will not.
The SCOTUS will select one of the appellant court cases to go forward. Not all of them. They will most likely select a case where the law was struck down. In case of a tie the lower court ruling would stand.

Answer: Private health insurers go out of business, and everyone will rely on public health care coverage.
Without the individual mandate, private insurers will need to jack up their premiums in order to stay in business since they will still be required to cover all of their customers health needs. This will cause more people to drop their coverage until they have a major health issue. Eventually privatized health care will go out of business, and anyone looking for help with their medical expenses will turn to government programs, which are supplemented with our tax dollars.

I am hoping that the SCOTUS can decide on this asap, however if they were to only rule the individual mandate as unconstitutional then how are we going to pay for half of the bill?
I guess nationalized health care is the answer?
Answer: That's not how it works. While congress CAN choose to make portion of a bill severable for the purposes of court challenges, ObamaCare specifically was designed so that if the individual mandate went down, the whole bill goes down. They thought this was a bold strategy, effectively daring the court to go big or go home (hoping they would go home).
